Terms of Use Agreement
Welcome to Accreditation Checkmate! The following are the terms of use (“Terms”) that govern your use of the Checkmate site and applications where this appears (the “Site”). By visiting or using the Site you expressly agree to these Terms, as may be updated from time to time. Accreditation Checkmate may make changes to these Terms at any time, effective immediately upon our posting them to the Site.
Accreditation Checkmate does not take responsibility for any violations of applicable laws, rules, and regulations by the User. In addition to complying with these terms, the User may not:
- Use this Site for any unlawful purpose
- Impersonate any person or entity, actual or fictitious, including any Checkmate employee or representative
- Allow anyone who does not have the proper credentialing and/or access privileges to utilize the software
- Submit material that would be in violation of any and/or all HIPAA and such related protocols and standards
- Submit material or provide hyperlinks to material that could reasonably be considered harmful, obscene, pornographic, abusive, threatening, harassing or otherwise objectionable
- Attempt to or actually remove any intellectual property belonging to Accreditation Checkmate
Health Economic Advisors (HEA) and Accreditation Checkmate are not responsible for any violations of this agreement by the User. Furthermore, HEA may investigate any violations of the Terms including but not limited to unauthorized use of the Site. HEA may pursue any legal action it deems necessary. The failure or delay of HEA to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
If HEA determines that you have violated these Terms or other applicable law, or for any other reason, we may cancel your account, delete any or all of your content, and prevent you from further accessing the Site. HEA shall not be liable to you or any third party for termination of your access to the Site or to your account and/or any information related to your account.
HEA shall not be liable under any circumstances or under any legal theory, whether in tort, contract, or otherwise, with respect to the Accreditation Checkmate site. You hereby waive all rights to seek direct, indirect, incidental, special, or consequential damages of any type.
Should anyone bring a claim against HEA or Accreditation Checkmate related to your use of the Site or your violation of these Terms, you agree to indemnify, defend and hold HEA, Accreditation Checkmate and any of our affiliates harmless from and against all claims, damages, losses, and expenses of any kind (including reasonable legal fees and costs). HEA reserves the right to take exclusive control and defense of any claim, and you agree to cooperate fully with HEA in asserting any defenses available. The terms of this agreement shall be governed by and in accordance with the laws of the State of Florida.
